We also inform about the rights of individuals whose data we process.<\/p>\n\n<p>For specific or additional activities and tasks, additional privacy policies and other legal documents such as General Terms and Conditions (GTC), Terms of Use, or Participation Terms may apply.<\/p>\n\n<p>We are subject to Swiss data protection law as well as potentially applicable foreign data protection law, such as that of the European Union (EU) with the General Data Protection Regulation (GDPR). The European Commission <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32000D0518\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">recognizes<\/a> that Swiss data protection law ensures adequate data protection.<\/p>\n\n<h2 id=\"kontaktadressen\">1. Definitions and Legal Bases<\/h2>\n\n<h3 id=\"begriffe\">2.1 Definitions<\/h3>\n\n<p><strong>Personal data<\/strong> refers to <em>any<\/em> information relating to a specific or identifiable natural person. An <strong>affected person<\/strong> is a person whose personal data we process.<\/p>\n\n<p><strong>Processing<\/strong> includes <em>any<\/em> handling of personal data, <em>regardless<\/em> of the means and methods used, such as querying, comparing, adapting, archiving, storing, extracting, disclosing, obtaining, recording, collecting, deleting, disclosing, organizing, storing, modifying, distributing, linking, destroying, and using personal data.<\/p>\n\n<p>The <strong>European Economic Area&nbsp;(EEA)<\/strong> includes the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Member_states_of_the_European_Union\" rel=\"nofollow noopener\" target=\"_blank\">Member States of the European Union<\/a>&nbsp;(EU) as well as the Principality of Liechtenstein, Iceland, and Norway. The General Data Protection Regulation&nbsp;(GDPR) refers to the processing of personal data as the processing of personal data.<\/p>\n\n<h3 id=\"rechtsgrundlagen\">2.2 Legal Bases<\/h3>\n\n<p>We process personal data in accordance with Swiss data protection law, especially the <a href=\"https:\/\/www.admin.ch\/opc\/en\/classified-compilation\/20224491\/index.html\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" id=\"97173\">Federal Data Protection Act<\/a> (Data Protection Act, DPA) and the <a href=\"https:\/\/www.admin.ch\/opc\/en\/classified-compilation\/20225687\/index.html\" rel=\"nofollow noopener\" target=\"_blank\">Data Protection Ordinance<\/a> (Data Protection Ordinance, DPO).<\/p>\n\n<p><span id=\"rechtsgrundlagen-dsgvo\">We process \u2013 if and to the extent the General Data Protection Regulation (GDPR) is applicable \u2013 personal data according to <em>at least<\/em> one of the following legal bases:<\/span><\/p>\n\n<ul>\n<li><a href=\"https:\/\/gdpr-info.eu\/art-6-gdpr\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6(1)(b) GDPR<\/a> for the necessary processing of personal data for the performance of a contract with the data subject and for carrying out pre-contractual measures.<\/li>\n<li>Art. 6(1)(f) GDPR for the necessary processing of personal data to protect the legitimate interests of us or third parties, unless the fundamental rights and freedoms of the data subject prevail. Legitimate interests include, in particular, our interest in exercising our activities and tasks permanently, user-friendly, safely, and reliably, as well as communicating about them, ensuring information security, protection against misuse, enforcing our legal claims, and complying with Swiss law.<\/li>\n<li>Art. 6(1)(c) GDPR for the necessary processing of personal data to fulfill a legal obligation to which we are subject under potentially applicable law of Member States in the European Economic Area (EEA).<\/li>\n<li>Art. 6(1)(e) GDPR for the necessary processing of personal data to perform a task carried out in the public interest.<\/li>\n<li>Art. 6(1)(a) GDPR for the processing of personal data with the consent of the data subject.<\/li>\n<li>Art. 6(1)(d) GDPR for the necessary processing of personal data to protect the vital interests of the data subject or another natural person.<\/li>\n<\/ul>\n\n<h2 id=\"art-umfang-zweck\">3. Type, Scope, and Purpose<\/h2>\n\n<p>We process personal data that is <em>necessary<\/em> to carry out our activities and tasks permanently, user-friendly, safely, and reliably. Such personal data may include categories of inventory and contact data, browser and device data, content data, meta and edge data, usage data, location data, sales data, as well as contract and payment data.<\/p>\n\n<p>We process personal data for the <em>duration<\/em> necessary for the respective purpose or purposes or as required by law. Personal data that is no longer required for processing will be anonymized or deleted.<\/p>\n\n<p>We may have personal data processed by <em>third parties<\/em>. We may process personal data jointly with third parties or transmit it to third parties. Such third parties are specialized providers whose services we use. We also ensure data protection with these third parties.<\/p>\n\n<p>We process personal data only with the consent of the data subject, unless processing is permissible for other legal reasons. Processing without consent may, for example, be permissible to fulfill a contract with the data subject and for corresponding pre-contractual measures, to protect our overriding legitimate interests because processing is evident from the circumstances, or after prior information.<\/p>\n\n<p>In this context, we particularly process information that an affected person voluntarily submits to us when contacting us \u2013 for example, by postal mail, email, instant messaging, contact form, social media, or telephone \u2013 or when registering for a user account. We may store such information, for example, in an address book, in a Customer Relationship Management System (CRM System), or using similar tools. When we receive data about other individuals, the transmitting individuals are obligated to ensure data protection for these individuals and ensure the accuracy of this personal data.<\/p>\n\n<p>We also process personal data that we\n\n receive from third parties, obtain from publicly accessible sources, or collect when carrying out our activities and tasks, to the extent and as long as such processing is legally permissible.<\/p>\n\n<h2 id=\"ausland\">4. Personal Data Abroad<\/h2>\n\n<p>We generally process personal data in Switzerland and the European Economic Area&nbsp;(EEA). However, we may also export or transmit personal data to other countries, especially for processing or processing by others.<\/p>\n\n<p>We may export personal data to all <a href=\"https:\/\/en.wikipedia.org\/wiki\/List_of_countries_and_dependencies_and_their_capitals_in_native_languages\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">countries and territories on Earth<\/a> and elsewhere in the <a href=\"https:\/\/www.datenschutzpartner.ch\/2022\/04\/23\/datenschutzerklaerung-daten-export-universum-mond\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Universe<\/a> where the local law, according to the <a href=\"https:\/\/www.admin.ch\/opc\/de\/federal-gazette\/2022\/1879.pdf\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Swiss Federal Council&#8217;s decision<\/a>, ensures adequate data protection and \u2013 if and to the extent the General Data Protection Regulation&nbsp;(GDPR) is applicable&nbsp;\u2013 according to the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX:32010D0087\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">European Commission&#8217;s decision<\/a> ensures adequate data protection.<\/p>\n\n<p>We may transmit personal data to countries whose law does not ensure adequate data protection, provided that data protection is ensured for other reasons, especially based on standard data protection clauses or other appropriate safeguards. Exceptionally, we may export personal data to countries without adequate or appropriate data protection if the special data protection requirements are met, such as the explicit consent of the data subjects or a direct connection to the conclusion or execution of a contract. Upon request, we will be happy to provide data subjects with information about any safeguards or provide a copy of any safeguards.<\/p>\n\n<h2 id=\"rechte\">5. Rights of Data Subjects<\/h2>\n\n<h3 id=\"ansprueche\">5.1 Data Protection Claims<\/h3>\n\n<p>We grant data subjects all claims under applicable data protection law. This includes the processed personal data as such, but also, among other things, information about the purpose of processing, the duration of retention, any disclosure or transfer of data to other countries, and the origin of personal data.<\/li>\n<li><strong>Rectification and Restriction:<\/strong> Data subjects can rectify incorrect personal data, complete incomplete data, and restrict the processing of their data.<\/li>\n<li><strong>Erasure and Objection:<\/strong> Data subjects can have personal data erased (&#8220;right to be forgotten&#8221;) and object to the processing of their data with effect for the future.<\/li>\n<li><strong>Data Disclosure and Data Transfer:<\/strong> Data subjects can request the disclosure of personal data or the transfer of their data to another controller.<\/li>\n<\/ul>\n\n<p>We may postpone, restrict, or refuse the exercise of data subjects&#8217; rights within legally permissible limits. We may advise data subjects on any conditions that may need to be fulfilled for the exercise of their data protection rights. For example, we may refuse to disclose information with reference to business secrets or the protection of other individuals, in whole or in part. For example, we may also refuse to delete personal data with reference to legal retention obligations, in whole or in part.<\/p>\n\n<p>We may exceptionally provide for costs for the exercise of rights. Data subjects are obliged to cooperate.<\/p>\n\n<h3 id=\"beschwerderecht\">5.2 Right to Lodge a Complaint<\/h3>\n\n<p>Data subjects have the right to enforce their data protection claims in court or to lodge a complaint with a competent data protection supervisory authority.<\/p>\n\n<p>The data protection supervisory authority for private controllers and federal authorities in Switzerland is the <a href=\"https:\/\/www.edoeb.admin.ch\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Federal Data Protection and Information Commissioner<\/a>&nbsp;(FDPIC).<\/p>\n\n<p>Data subjects also have the right, if and to the extent the General Data Protection Regulation&nbsp;(GDPR) is applicable, to lodge a complaint with a competent <a href=\"https:\/\/edpb.europa.eu\/about-edpb\/about-edpb\/members_en\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">European data protection supervisory authority<\/a>.<\/p>\n\n<h2 id=\"sicherheit\">6. Data Security<\/h2>\n\n<p>We take suitable technical and organizational measures to ensure data security appropriate to the respective risk. However, we cannot guarantee absolute data security.<\/p>\n\n<p>Access to our website is via transport encryption (SSL \/ TLS, especially with Hypertext Transfer Protocol Secure, abbreviated as HTTPS). Most browsers indicate transport encryption with a padlock in the address bar.<\/p>\n\n<p>Our digital communication is subject to mass surveillance without cause and suspicion, as well as other surveillance by security authorities in Switzerland, the rest of Europe, the United States of America (USA), and other countries. We cannot directly influence the processing of personal data by intelligence agencies, police authorities, and other security authorities.<\/p>\n\n<h2 id=\"website\">7. Use of the website<\/h2>\n\n<h3 id=\"cookies\">7.1 Cookies<\/h3>\n\n<p>We may use cookies. Cookies &#8211; both first-party cookies and third-party cookies from services we use &#8211; are data stored in the browser. Such stored data may not be limited to traditional text-based cookies.<\/p>\n\n<p>Cookies can be stored in the browser temporarily as &#8220;session cookies&#8221; or for a specific period as so-called permanent cookies. &#8220;Session cookies&#8221; are automatically deleted when the browser is closed. Permanent cookies have a specific storage duration. Cookies, in particular, allow recognizing a browser on the next visit to our website, thereby measuring the reach of our website. Permanent cookies can also be used for online marketing.<\/p>\n\n<p>Cookies can be disabled or deleted entirely or partially in the browser settings at any time. Without cookies, our website may not be fully available. The information is required to provide our website permanently, user-friendly, and reliably and to ensure data security, especially the protection of personal data &#8211; also by third parties or with the help of third parties.<\/p>\n\n<h3 id=\"zaehlpixel\">7.3 Tracking pixels<\/h3>\n\n<p>We may use tracking pixels on our website. Tracking pixels are also called web beacons. With tracking pixels &#8211; also from third parties whose services we use &#8211; small, usually invisible images are automatically retrieved when visiting our website. For any such consent, we use the &#8220;Double Opt-in&#8221; procedure whenever possible, which means you receive an email with a web link that you must click to confirm, to prevent misuse by unauthorized third parties. We may log such consents, including Internet Protocol (IP) address as well as date and time for evidence and security reasons.<\/p>\n\n<p>You can generally object to receiving notifications and messages such as newsletters at any time. With such an objection, you can also object to the statistical tracking of usage for success and reach measurement.
